中国FTA版权政策的基本立场

缔结双边自由贸易协定即FTA，已成为后WTO时代国际贸易体制新的发展方向。在对外谈判和缔结FTA的过程中，中国始终坚持从现实国情出发，力求协议的缔结有助于推动本国经济、社会持续健康发展。在FTA版权基本政策方面，中国坚持以TRIPs协定为标准，不盲目在双边贸易协定中提高版权的保护水平，确保版权保护水平与中国经济和社会的发展状况相协调。尽管如此，对于某些各国做法不一、尚无国际统一标准的版权问题，中国在谈判中，还是有一定的回旋空间，可以在个别版权条款的选择上做出必要的让步。

China＇ s Basic Position on FTA Copyright Policy

In the post -WTO era, concluding bilateral free trade agreement （FTA） has become one of the new trends in inter- national trade system. In the process of negotiation and concluding of FTA, China has always proceeded from the actual national conditions, and strived to promote the sustainable and healthy development of economy and society. As to the basic FTA Copy- right Policy, China insists adherence to the TRIPs Agreement, avoids blind increase of copyright protection level in bilateral trade agreements, so as to ensure harmonizing copyright protection level with China＇ s economic and social development. Despite of this, there still is room for necessary concessions and compromises to tackle specific copyright issues, when there are not uniform copy right criteria in the world and each country follows its own principles.
