“春晚”在著作权法上的定性

摘    要:关于“春晚”在著作权法上的定性,在司法实践中法院的判决存在分歧,理论界对此也有较大的争议。将“春晚”定性为汇编作品不符合“春晚”的本质属性,也不符合演出行业的行业惯例和公众常识,并不能实现作品著作权人和作品传播者利益平衡的目的。现场演出的“春晚”本质上就是一台由众多精选节目组成的综艺演出活动,是多种类型作品之表演的汇集,应该由表演活动的组织者依法享有表演者权,录制后的“春晚”属于录音录像制品,受邻接权保护。

Abstract:There exist wide dissents and disputes in both judicial practice and theoretical circle concerning the copyright nature of CCTV Spring Festival Galas .Defining CCTV Spring Festival Galas as collective works neither reflects the galas ’ essential na-ture, nor conforms to the custom practice in the show business and the public common sense .Naturally, it fails to balance the in-terests of art works ’ copyright owners and disseminators .In essence , live performances of CCTV Spring Festival Galas consist of numerous carefully selected art programs , forming a collection of multiple styles and types .Accordingly , the live performance or-ganizers should legally enjoy the performer rights , while videoed performances fall within the category of audio -visual products and should be protected by neighboring rights .
