法视角下的"996类超长工时制"

摘    要:"996"加班现象热议的背后透露出更为深刻的理论问题。这种超长工时制一方面不仅透支着劳动者的身心健康,还无益于用人单位效益的增加,另一方面也严重违反我国相关劳动法律规范,更是赤裸裸地违背良善社会的伦理道德规范,是对整个社会可持续性劳动再生产能力的破坏和未来生产能力的无限制消耗,严重侵犯和损害了劳动者的身心健康与个人发展权利。而人权保障和和谐社会的要求决定了我们需要从价值观念引导、社会治理等多方面有效地保护劳动者权利,及时扼制各类违法、无序的加班行为。这不仅是为了保护劳动者的合法权益,更是因为劳动幸福是全世界共同追求的目标。

“996 Super-long Working Hours” from the Perspective of Law

Abstract:A more profound theoretical problem lies behind the heated debate about "996" working overtime.The long working-hours system on the one hand, not only consumes the physical and mental health of the workers, but also is not conducive to the increase profits of the employers. Moreover, it is a serious violation of the relevant labor laws in our country, especially stark against the ethics of the good social ethics and is the damage to the entire social sustainability of labor reproduction and is unlimited consumption for future production capacity;it is a serious violation to and damaged the physical and mental health and personal development rights of the workers. The protection of human rights and the requirements of a harmonious society determine that we need to effectively protect the rights of workers from the guidance of values, social governance and other aspects, and timely curb all kinds of illegal and disorderly overtime activities, not only to protect the legitimate rights and interests of workers, but also to achieve labor happiness which is the common pursuit of the world.
