| 摘 要： | 以自由化为基础的区块链技术为国际服务贸易的发展提供了新的机遇，但当前缺乏规范区块链的国际法律制度，妨碍了区块链技术的进一步应用。GATS生效后，区块链才出现，但其技术流程符合GATS中计算机及相关服务下数据处理服务的要求。这为国际法规制区块链提供了可能。区块链的国际法规制途径主要有三个方面：首先，将GATS适用于包括区块链在内的数字贸易；其次，推动《服务贸易协定》中的数字贸易议程，以促进区块链自由化；最后，签署包含规范数字贸易问题专章的区域贸易协定。

| Abstract: | Blockchain technology,based on liberalization,provides new opportunities for the development of international trade in services.However,the current lack of international legal system to regulate blockchain has hindered the further application of blockchain technology.Although blockchain came into being after GATS,its technical process meets the requirements of data processing services under computers and related services in GATS,making it possible for international law to regulate blockchain.There are mainly three ways to regulate blockchain in international law:first,to apply GATS to digital trade including blockchain;second,to advance the digital trade agenda of the Trade in Services Agreement to facilitate blockchain liberalization;and finally,to sign regional trade agreements containing special chapters regulating digital trade issues. |
