试论高丽与中国法制关系之演进——以"华化"与"土俗"之争为中心

高丽是一个比较典型的贵族社会,王权微弱。故而在统一之后,高丽并没有创法立制,制度文物多因袭新罗之旧。光宗时期,发动了华化运动,但因触动了贵族集团的根本利益,在推行十几年后归于失败。成宗时,王权与贵族集团达成了妥协,在尊重贵族集团既得利益的基础上,王权才可以较大规模地移植中国制度,但不得不迁就土俗,对唐代制度进行改造和变形。到了文宗时期,又开始移植宋制,出现了华制与土俗混合的现象。在蒙元王朝直接控制的时期,高丽蒙古化、中国化的趋势加快,到了高丽末期,全盘华化的政策终于确立。
