| 摘 要： | 所有物返还请求权与排除妨害、预防妨害请求权虽同为物上请求权 ,但无论是在客体上还是在法律后果上两者之间存在着很大差异。对它们能否适用诉讼时效的问题不应一概而论 ,而应区别对待。除已登记财产之返还请求权可以不适用诉讼时效外 ,排除妨害、预防妨害请求权以及未登记财产之返还请求权均应适用诉讼时效

| Abstract: | There are three main rights of the owner,such as the right of the owner to reobtain the property,the right of the owner to eliminate the obstacles and the right of the owner to prevent to infringement.But the former and the rest are quite different in its objects and its legal consequence .One of the big difference between them is whether they can apply the time limitation of action.The author points out the right of elimination and the right of prevention and the right of owner whose properties are registered to reobtain his (her) property can't apply the time limitation of action. |
