| 摘 要： | 规范性文件备案审查机制面临有限资源无法充分满足日益增长需求的瓶颈.我国法律对规范性文件的审查程序有具体的规定,但审查建议的受理缺乏较为明确的标准和程序.美国最高法院和德国联邦宪法法院在规范性文件审查的制度实践中,形成了一套遴选机制,起到了一定的效果,值得我国借鉴.我国应明确规范性文件审查的功能定位,形成规范性文件审查建议的遴选标准,细化规范性文件审查建议的遴选程序,增加规范性文件审查建议遴选的透明度,以完善规范性文件审查建议的遴选机制.
