论意思表示的构成要素

我国传统的民法理论对意思表示的构成要素多有歧见,这事实上表现为民事立法中对法律行为一般构成要件的不同认识。在对意思表示之发生、发展过程作实证分析后可知:目的意思、效果意思和表示行为三者对于意思表示均不可或缺,系意思表示的构成要素;而表示意思或可为效果意思所吸收,或可为表示行为所吸收,因而不是构成意思表示的必备要素。

Components of Intention Manifestation

In the traditional theories of civil law in our country,there is amount of dissent to the leading idea of the components of manifestation of intention,which is expressed as different cognitions of general constitutive(requirements) of legal acts in civil legislation.After analyzing the occurrence and development of manifestation positively,we could know that purpose intention,effect intention and expressing behavior,are all indispensable for manifestation of intention and they are components of manifestation of intention.However,expressing intention is not an essential component of manifestation of intention,because it can be absorbed by effect intention or by expressing behavior.
