| 摘 要： | 针对当前司法实践中地区管辖难以认定的法律困境,已经出台的一系列司法解释,提供了无权管辖的解决思路和处理模式。本文从无权管辖的合理性和正当性分析入手,就无权管辖的程序完善涉及到的程序安定、程序法定、侦查管辖与审判管辖的中心地位协调、管辖救济途径的确立及滥用预防等一系列诉讼理论问题进行探讨,并建议通过立法确立无权管辖制度,以此来帮助构建、完善一种科学、合理、高效的地区管辖方案,为完成刑事诉讼法再修改提供必要的理论支撑。
