| 摘 要： | 本文认为道德与法律之间存在深刻的一致性，但又存在矛盾，两者在矛盾中向前运动与发展。以这一观点作指导，才能正确把握儒家思想的两千多年的历史，并才能对今天的道德与法制建设有清醒的认识。

| Abstract: | Thispaper holds that law and morality are consistent on the one hand,and contradictory on the other.Both sides develop in conflicts.Only by following this point of view can we have a good grasp of Confucianism that has been developingfor more than2000years,and can we understand correctly our moral and legal construction today. |
