| 摘 要： | 共同过失行为导致危害结果是一种客观存在的现象,我国刑法典没有规定其为共同犯罪。本文从对现存有关的主要理论分析入手,界定共同过失正犯的概念特征,说明共同行为、共同注意义务的特征并对共同过失正犯进行分类,最后对共同过失正犯的必要性进行了简单的论证。

| Abstract: | The behavior of joint negligence leading to an illegal result is an objective reality.It is not regulated as the joint crime in China's criminal code.Based on an analysis of dominant relevant theories,the paper tries to define and discuss the concept and the attribute of offense of joint negligence,as well as the characteristics of joint duty of care.The paper also sorts out the offense of joint negligence and points out the necessity of enacting the offense of joint negligence as a joint crime. |
