| 摘 要： | 法律的主要功能在于禁恶,并提供正面激励,使人们积极守法.侵权责任归责原则的适用可以有效的改变经济人的成本-收益结构,使经济人不因侵权而获利,不因受损而得不到赔偿,从而激励经济人作出遵循法律的选择.侵权责任原则的适用实际上是通过侵权双方当事人的责任的分配实现社会公平和最大效益.
