高等院校校名商标权保护研究

目前,国内高校校名主要依据《中华人民共和国民法通则》享有名称权保护。与企业名称保护相比,由于缺少专门的法律法规等原因,高校校名实际享有的名称权保护很有限。而且,随着我国社会主义市场经济的深入发展,高校校名在社会生活的多个领域凸现着重要的标识作用,因而,高校校名的商标属性日益明显。根据中国当前的国情,高校校名的商标权保护可从以下三方面入手:适用使用在先原则、保护范围扩大为全社会和知名高校校名实行品牌化保护。

A Study on Trademark Right Protection of Names of Colleges and Universities

At present,the name right of colleges and universities is protected according to China's general rule of the civil law.Compared with the protection of enterprise's name,the name protection of colleges and universities is limited due to the lack of specific laws.With the further development of Chinese socialist market economy,the names of colleges and universities have become important marks in many fields and thus school names have demonstrated a more apparent quality of trademarks.Based on China's current situation,the paper suggests that the trademark right of colleges and universities should be protected from three aspects: the principle of first to use should be implemented;the scope of protection should be broadened to the whole society;and names of famous colleges and universities should be protected as brand names.
