| 摘 要： | 社会和谐是中国特色社会主义的本质属性，利益关系妥善协调是和谐社会的本质要求。利益关系的法律调整是国家通过法律规范的制定和实施，确认、权衡各种利益并以此为依据解决利益冲突，从而实现利益关系的妥善协调。社会主义和谐社会中利益关系的法律调整应当坚持权利本位、统筹兼顾和利益分享，遵循明晰化和谦抑性原则。

| Abstract: | Social harmony is the essential attribute of the socialism with Chinese characteristics, of which the benefits coordination is the essential request. The legal adjustment of benefits is the process to realize benefits coordination by the formulation and implementation of national law, the confirmation and balance of benefits and the solution of benefit conflict. The above adjustment must insist the clear and modest principles of rights-centeredness, overall consideration and benefit-sharing. |
