| 摘 要： | 在黑格尔的法哲学体系中，自由意志是法的出发点和主体，法是自由意志的定在。作为法的不同发展阶段的抽象法、道德和伦理，是自由意志由低到高、由自在到自为的发展过程。因此，道德、法律、伦理都是自由意志定在的不同形态和不同阶段，它们的辩证运动构成了一个有机整体和辩证过程。由自由意志与法的精神的内在关联以及法与德的有机整体性可知，社会治理的合理性，不是抽象的德治或抽象的法治的合理性，而是道德-法律、德治-法治的生态整合。

| Abstract: | According to Hegel, free will is the starting point of right, and right is the expression of free will. Law, morality and ethics are the different stages of right. They reflect the development of free will from primary level to higher level. The dialectic development of the stages forms an organic whole process. Therefore,free will and right are intrinsically unified. The social rationality does not lie in the raionality of moralitygoverning or law-governing, but rather in the ecological integration of morality and law. |
