| 摘 要： | 财产保险合同是以财产及其有关利益为保险标的的保险合同。财产保险合同的成立要件、生效原因、终止时间与其他合同比较有明显的特殊性。财产保险合同应属于不要式合同,其成立的时间应是保险当事人就保险合同的条款达成一致时;保险费的缴交是合同履行问题,不应将保险费缴交的时间作为财产保险合同法定的生效时间;财产保险合同的终止一般向后产生约束力,但在法定或有约定条件存在时,也向后产生溯及力。

| Abstract: | The contract of property insurance is the contract that takes the property and relavant benefits as the project it insures.Compared to other kind of contracts,the components,the reasons it goes into effect,as well as its duration all has an obvious character.The time it begins to work is from the date when both parties agree to the items in the contract.The premium is the matter of implementing the contract therefore the time of payment should not be the time the contract begins to go into effect.The end of the contract of property insurance could be generally postponed for sometime. |
