| 摘 要： | 刑事政策尤其是行刑政策对罪犯权利既具有限制性,也具有确认和保障性.刑事政策必须在维持社会公正和保障罪犯权利间获得平衡.目前我国的刑事政策尤其是具体行刑政策的调整对罪犯权利的影响更多是积极的.但是.刑事政策在制定和实施过程也将面对诸多来自监狱和社会的压力. |

| Abstract: | Criminal policy especially the policy of punishment of execution limit prisoners' rights,on the other side,the policy also confirms and prevents rights.Therefore,criminal policy must balance the maintaining social justice and security of prisoners' rights.At present our country's criminal policy especially the policy of punishment of execution has positive influence.But it will face greater pressure from the prisons and society. |
