中国外资企业融资上市的法律调控

中国加入WTO后,有关外商投资企业上市融资的相关法律问题逐渐清晰显现.但现有相关法律法规及政策明显滞后,加上中国证券市场未全部开放,阻碍了外商投资企业上市的步伐,在一定程度上影响了中国引进外资、利用外资发展经济的目标.因此,在外资政策、证券法、反垄断立法等方面加以完善,将有助于引导外商投资企业融资秩序有序健康地发展.

Legal Policy Research on Going into the Stock Market of Foreign Enterprises in China

After entering into the WTO,some related legal problems that foreign enterprise goes into the stock market perform more and more clearly in China.But the existing related laws and policy can not meet the requirement,and China's stock market has not opened completely.Those problems slow down the step which foreign enterprise goes into the market,and will affect the introduction of foreign capital,using foreign capital in national economic development in certain degree.Therefore,we should do some consummations in our foreign capital policy,the legislation of Security Law,Anti-trust Law and so on,and we believe these measures will be helpful to guide the financing order of foreign enterprise and develop healthily.
