我国扶养制度的法律文化解读

中国的法律传统自近代以来逐渐受到西方法律思想及其制度的影响,尤其受到民法传统的法律思想的影响。新中国成立后,新的法律制度的建立是以废除旧法为基础的。但是,废除旧法也并非完全割断了与旧法的联系,中华法律的发展是一个连续的过程。所谓否定旧法,只是对那些法律政策以及法律中所反映的某些政治思想的否定。而对于那些根植于一般社会生活规律和悠久历史文化基础上的法律思想和道德观念以及具体的道德规范,无论古今中外,都须予以接受。作为婚姻家庭法的重要组成部分的扶养制度,同样是这一发展进程中的一环。对扶养制度的法律文化解读,可以从一个相对崭新的视角探究我国婚姻法关于扶养制度的精神内涵。

Study on Legal Culture of Maintenance System in China

In China,legal tradition was gradually influenced by Western Law System,especially civil law tradition from modern times.With the establishment of Chinese People Republic of China,the new legal system was based upon abolition of those old.It should not be ignorant that legal system is an unintermitted course in which there is connection between the new one and the old one.That means those legal ideas and moral notion being rooted in society and history should be reserved anywhere and anytime.As one of the important elements of family law,maintenance system is in the same situation.Studying on such a legal system gives a new angle in which we can probe into the spirit of maintenance provisions in family law.
