| 摘 要： | 刑事辩护律师专业化包括辩护人专业化、业务分工专门化、法律服务专业化三层涵义,在实现了刑事辩护律师专业化的美国体现为严格执业资格、律师内部专业分工细、律师协作提供专业法律服务三个特点。以此为标准可以看出,我国刑事辩护律师专业化之路障碍重重:律师业自身发展的不成熟,保障性制度和激励机制的缺失以及律师执业环境的复杂等,这些障碍非一朝一夕能够跨越,必须通过长期的不懈努力。

| Abstract: | Criminal lawyer professionalization includes defender specialization,business division specialization,and legal service specialization.In America,which has realized criminal lawyers professionalization,there are three characteristics:strict requirments for professional qualifications,precise division of professional duties,and professional legal service.In contrast to the US practice,there are a lot of hindrance to the professionalization of criminal defense lawyer:the inadequate development of the Bar,the lack of indemnificatory system and the incentive mechanism,and the complexicity of lawyer’s practice environment,etc.These obstacles can only be surmounted after long and unremitting efforts. |
