| 摘 要： | 在婚姻法中设立无效婚姻制度,是当今世界多数国家的立法通例。我国于2001年通过对现行《婚姻法》的修正案,正式确立了无效婚姻制度。但我国《婚姻法》确立的无效婚姻制度中婚姻无效的事由不能涵盖现实生活中应当被认定为无效婚姻的各种情形,也未区分无效婚姻中有过错当事人与无过错当事人的法律责任,并且对婚姻被宣告无效和被撤销的法律后果没有进行区别对待。应该从解决这些问题入手对我国无效婚姻制度予以完善。

| Abstract: | It is common legislation practice in the majority of countries to adopt the system of void marriage. And this system was officially established in China after the amendment to the existing Marriage Law was enacted in 2001. However,the amendment fails to cover all the forms of void marriage in real life,and fails to discriminate the legal obligations between the party at fault and the non-fault party. Besides,the legal consequences of void and dissolved marriage are not clearly distinguished in the amendment,either. Therefore,the author holds that China’s void marriage system should be perfected by solving those problems. |
