基于反公地悲剧的教育产权制度改革研究

从公共管理的视角来看，“反公地悲剧”产生的根本原因在于缺乏有效的制度约束机制，而目前解决“反公地悲剧”最佳途径是由政府出面，整合产权，优化资源配置。当前，要解决中国公立高校产权制度改革面临的“反公地悲剧”现状，政府可以通过立法来构建一个以教育产权的重新界定、整合、使用以及交易为内容，以资源的优化配置为目标的公立高校产权管理体制，从根本上避免公立高校中的“反公地悲剧”现象。

A Study of the Reform of the Property Rights System in Public Universities Based on the Tragedy of the Anti-commons

This paper discusses the tragedy of the anti-commons as well as how to avoid the tragedy from the perspective of the public administration.We believe that "the tragedy of the anti-commons" is due to lack of an effective binding mechanism,and the best way to prevent the tragedy lies in the government's integrating the property rights and optimizing the allocation of resources.On this basis,we analyze "the tragedy of the anti-commons" which may occur in China's current reform of property rights system in public universities.And we hold that innovating property management system should be a top priority of public universities,which will help to avoid "the tragedy of the anti-commons".
