| 摘 要： | 船舶融资租赁作为一种崭新的船舶融资方式,是一种集租赁、买卖、金融信贷性质于一体的独立的交易.但正是由于船舶融资租赁是一种新型的交易形式,我国<海商法>尚未对其作出特别的规定.从船舶融资租赁合同的特点来看,其与光船租赁有相似之处,但也有本质区别,应依照<海商法>等海事法律法规以及<合同法>第十四章的规定来构建船舶融资租赁之若干制度.

| Abstract: | As one of the newest methods of ship financing,ship financial leasing is a unique business which has a multiple nature of leasing,vending and financial credit.It helps to fill up the insufficiency of the traditional ship financing and benefits the business of the republic of shipping.But because of its newness,the Maritime Code does not give special regulation on it.According to its features,ship financial leasing contract is similar to bareboat charter but different in nature.We should establish several rules of ship financial leasing according to the.Charter 14 of Contract law and the admiralty laws such as Maritime Code. |
