论宪政之于政治文明——发生、语境与功能视角

民主的政治催生使近现代宪政得以发生。宪政是当代政治文明的标志,宪政与政治文明交相辉映:价值层面,宪政思想是政治理念文明的鲜活表象;规范层面,宪政体制是政治制度文明的显赫精义;实践层面,宪政功能是政治行为文明的牢靠藩篱。政治文明的核心是宪政的实现,宪政的实现之日即是政治文明的彰显之时。在宪政与政治文明成为政治学、法学研究热点和社会关注焦点的现实条件下,思辨地考察当代政治文明建设中的宪政维度,无疑具有一定的时代价值。

On Political Civilization Resulted From Democratic Constitutionalism

Democratic constitutionalism is the essential content in building political civilization.In terms of the value aspect ,democratic constitutionalism thought is the live presentation of political belief civilization;In terms of the norm aspect,the system of democratic constitutionalism is the glorious connotation of political institutional civilization;In terms of the practice aspect,the function of democratic constitutionalism is the firm hedge of political action civilization;In terms of the development aspect,the center of political civilization is the accomplishment of democratic constitutionalism,In other words,the day on which democratic constitutionalism is accomplished is the time when political civilization is easily seen.At present,the view of politicalcivilization has been put forward by the Communist Party of China,amd moreover,democratic constitutionalism is becoming the hot point in laws,politics and social focus.Under such conditions,it has an important era significance to rationally review dialectically their correlation as well as their historical tendency.
