| 摘 要： | 食品监管渎职罪只能是疏忽大意的过失犯罪。在食品监管渎职罪中，行为人对违反食品监管法规持故意的过错心理，行为人对重大食品安全事故或者其他严重后果的发生没有认识或者行为人认为这种危害结果不会发生，其对重大食品安全事故或者其他严重后果的发生持漠不关心的情感态度。在司法实践中，应注意食品监管渎职行为因法规竞合所生诸罪名的认定，也要注意区分食品监管渎职罪与危害食品安全犯罪的界限。

| Abstract: | The crime of malfeasance in food regulation can only be neglectful misstep.The criminal’s psychological attitude to break to food law exclusively is deliberate in malfeasance in food regulation.The criminal’s attitude to havoc about food safety accidents has not recognized or the one don’t think that havoc would happen.The actor holds the indifference feelings attitude to the havoc.Should pay attention to the food regulatory malfeasance in judicial practice,we should pay attention to distinguish the boundaries of the food regulatory malfeasance crime and to identify the crime of endangering food safety from the crime of malfeasance in food regulation. |
