| 摘 要： | 在线交易后，经营者延迟履行合同、瑕疵履行义务的事情时常发生，中国法律应规定适当的最长履行期限和冷却期。在经营者违约情况下，网络交易平台提供商是否应承担相应的法律责任，取决于其是否违反法定和约定的义务，并且主观上是否有过错。
