| 摘 要： | 中国海外投资保证应该由直属政府控制的又具有独立法人资格的中国海外投资发展公司承保，应尽快制定《中国海外投资保险法》，签订或加入有关海外投资保证的双边或多边条约，形成国内与国际法相结合，经济法与实体法相配套的法律体系。

| Abstract: | The political risk of the Chinese oversea investment is guaranteed by the Chinese Oversea Development Company,which is controlled by the government directly and being independent as a legal person.The Law of Chinese Oversea Investment Guarantee should be soon drawn up with the signed bilateral or multilateral treaties.The comprehensive legal system should be completed with national and international laws,procedural and substantive laws. |
