论宪法未列举的公民基本权利的具体化

本文采用比较分析和价值分析的方法,介绍公民基本权利具体化应遵循由抽象到具体、由概括到明确、由静态到动态、由确认到交互的基本原则。在对宪法进行修改时,应对基本权利的内容予以必要的扩充,对基本权利内容的规定也要明确,从而体现宪法限制权力、保障权利的宗旨;应使基本权利在一般法中均得到明确、具体的规定;应在宪法中确认宪法的直接效力,同时赋予人民法院对宪法的解释权;在宪法中增加未列举权利的条款,确立公民基本权利全面保护的原则。

The Basic Citizen Rights Not in the Constitution
