| 摘 要： | 侦查程序中权力配置存在的最大问题就是侦查机构作为追诉犯罪的暴力机关而拥有较大的权力,如果其滥用国家权力就会使公民个人乃至整个社会面临极大的危险。因此,应在现代诉讼理念指导下,探究中国侦查程序职权合理配置的路径,使之形成对侦查权的制约,保证侦查权的有效行使。

| Abstract: | The most serious problem of the powers distribution in the investigation process is that the investigative agency has greater power as a violent criminal prosecution authority,and its abuse of state power will engender individuals and society at great risk.Therefore,we should explore the rational route to deploy the powers in the investigation process of China in order to restrict the investigation power and ensure the effective exercise of it under the guidance of modern legal concept. |
