| 摘 要： | 农忙止讼是我国古代一项富有特色的重要制度,郑显文先生对之进行了积极的开拓性研究,应该予以充分肯定。但就郑先生的论证方法和史料运用来看,其观点则尚不能令人信服。从唐高祖武德六年(623年)六月的《劝农诏》和日本《养老令》的成书时间来看,我国古代农忙止讼制度的形成时间应该早于开元六年(718年)甚至可能早于唐朝。今天学界复原的开元二十五年(737年)令中有农忙止讼的规定,但不能因此就误认为农忙止讼制度首创于开元二十五年(737年)令。

| Abstract: | Mr.Zheng Xianwen has done actively pioneering research on stopping the litigation system during the rural busy season in ancient China but his view is still not convincing from he used the arguments method and historical materials.From the promulgated time of Quannong zhao issued in June 623,the sixth year of Emperor Tang Gaozu and Japanese Pension Order,the formation time of this system should be earlier than 718 and even came out before Tang dynasty.Scholars today discovered this system in the decrees of ... |
