| 摘 要： | 《中华人民共和国涉外民事关系法律适用法》没有对船舶物权的法律适用问题作出规定，因此仍应根据《海商法》的规定来确定船舶物权的准据法。然而，《海商法》中相关的冲突规则已渐显陈旧，很多条文已经不能为现实的纠纷提供指引。本文结合新法的指导思想及国内的司法实践，对船舶所有权、留置权、以及各担保物权受偿顺序的法律适用问题进行分析，并提出相应的立法建议。

| Abstract: | Law of the Application of Law for Foreign-related Civil Relations of the People’s Republic of China is formally effective from 1th April this year.As the new law doesn’t provide application of law for real right of ship,we have to sumit to the Maritime Law to determine the applicable law thereof.The provision of Maritime Law is old-fashioned that it can not give good guides to the issue any longer.This article combines the doctrine of the most significant with judicial practice of our country,trying to give some humble advice to application of law about proprietary right,lien and sequence of real right of pledge. |
