土地管理体制改革的制度安排与学术研究态势

土地管理体制包含行政管理组织体制和土地行政管理方式。2004年以后土地行政管理组织体制转变为土地垂直管理体制,管理方式继续沿袭改革开放以后逐渐形成的"事前用途管制、事中行政审批、事后调控整治"。学术界对这一土地管理体制进行大量的研究,通过运用文献综合法和对比法,梳理2004年后土地垂直管理体制的研究观点,发现研究的重点主要集中在地方实际运行、体制的运行机制和深化体制改革三个取向上。倡导改革土地管理体制的观点集中在理顺各级各部门管理职能权责、改革用途和规划管制方式、建立管理体系、强化监督机制四个方面。

The System Arrangement of Land Management Reform and the Academic Research Situation

Land management system includes administration organization system and land administration mode. After 2004, the land administrative organization system had changed into the land vertical management system in China. Administration mode continued to follow ＂use control in advance, the administrative examination and approval in the matter, control and regulation afterwards ＂which had formed gradually after the reform and opening up. Many scholars had engaged in the research on this land management system, the main of which is focused on the local practical operation, system and system reform, the operation mechanism of system and system reform, through combing the academic research on vertical land management system after 2004,by the literature synthesis method and comparison method. The point of advocating the reform of land management system focused on four aspectsstraighting out the functions and responsibility among the various departments at all levels , reforming the mode of purpose control and planning, establishing a unified management system and strengthening the supervision mechanism.
