道德与法在诚信建设中的辩证互动

中西方不同的人文环境和社会条件分别造就了德性诚信和法理诚信的传统。社会主义市场经济条件下诚信缺失的原因可从德性诚信尚未实现现代转型和法理诚信原则“纸面化”、规则匮乏两方面加以解读。加强诚信建设,塑造公民的诚信人格,既要重视道德与法的独立作用和价值,又要促使道德与法的良性互动、功能互补。

On Dialectic Interaction between Morality and Law in the Construction of Sincerity

Different humane environments and social conditions have created in China and western countries respective traditions of sincerity founded on morality and sincerity based upon legal principles.The lack of sincerity under the condition of socialist market economy can be interpreted from two aspects: sincerity founded on morality has not yet been modernized,and sincerity based upon legal principles has been reduced to "empty talk",lacking in regulations.To strengthen the construction of sincerity and shape sincerity personality on the part of the citizens,not only should we attach importance to the independent functions and values of morality and law,but also facilitate positive interaction and mutual complementarities between morality and law.
