司法建议法律效力初探

司法建议作为人民法院审判职能的延伸,近年来在化解社会矛盾纠纷、提高社会管理水平方面日益发挥着重要的影响力,已成为一项具有中国特色的司法制度。本文通过对司法建议概念、特征的分析以及与相似制度的比较研究,认为司法建议在性质上虽然仍属建议类型,其法律效力相较于司法裁决应该是相对柔性的,不应对实践中存在的全部司法建议一体赋予法律效力;但在创新社会管理、倡导能动司法的时代背景下,对于预见防范型、改错纠正型的司法建议应赋予对被建议单位的法律约束力,并通过统一立法对司法建议的法律效力和运行机制予以规制。

Initial Exploration of the Legal Effect on Judicial Proposals

Judicial proposal,as an extension of the trial functions of the People’s Court,has played an increasingly important influence on resolving social conflicts and disputes,improving social management in recent years.And it has become a judicial system with Chinese characteristics.In this paper,the concept of judicial proposal,feature and comparison with the similar system has been analyzed.It has been concluded that judicial proposal,in essence,is still a proposal,its legal effect,compared to a judicial decision should be relatively flexible,it cannot give legal effect to deal with all the judicial recommendations in practice.But in the background of social innovative management and active justice,legally binding should be given to the proposed units on the judicial preventive proposal and the error corrective judicial proposal.And the legal effect and operation mechanism of the harmonization of legislation on the judicial proposal should be regulated.
