| 摘 要： | 改革开放以来,在邓小平理论、"三个代表"重要思想和科学发展观的指导下,我国马克思主义法的本质理论经历了重新认识、深化认识和创新认识三个发展阶段。其科学发展轨迹可以概括为:法的根源本质在坚持中发展创新,法的功能本质由感性走向理性,法的目的本质回归人性又超越人性。

| Abstract: | Under the guidance of Deng Xiaoping's Theory and important thoughts of the "Three Represents" and scientific outlook on development,essence theory in Marxist law undergone three phases since reform and opening up,namely,reassessment,deepened understanding and innovation. The development of essence theory can be summarized as:innovation on the basis of adherence in origin,transition from sensibility to rationality in function and returning to and transcending human nature in intention. |
