行业协会限制竞争行为的法律规制

行业协会限制竞争行为以行业协会的名义实施，表现为固定价格、划分市场等横向限制竞争行为和限制转售价格、独家交易等纵向限制竞争行为。由于行业协会所代表的特殊利益性，行业协会限制竞争行为更可能排斥其他竞争者的竞争、损害消费者的合法权益以及扰乱经济秩序，因此必须加以规制。通过与美国立法进行比较，我国《反垄断法》法律条文比较概括，没有规定判断行业协会限制竞争行为的具体标准．缺乏可操作性，此外，对行业协会的法律责任规定也比较简单，不足以发挥法律的威慑作用和救济作用。针对这些问题，应在立法中明确适用本身违法原则和合理原则来判断行业协会的行为是否限制竞争，同时为了更好地规制行业协会限制竞争行为，监管机构应建立事前预防和事后处治制度。

Legal Regulation on the Trade Associations＇ Behaviors Restricting Competition

Acts of trade associations to restrict competition are implemented in the name of trade associations,expressed as fixed price, division of markets, restricting resale price and exclusive dealing etc. As the trade as; sociation representing special interests, industry associations are more likely to limit competition, harm the legitimate rights and interests of consumers and disrupt the economic order, so it is necessary to regulate acts of trade associations to restrict competition. Comparing with the United States, China＇s antimonopoly law does not provide for restrictions on trade associations to determine the specific criteria-competitive behavior, lack of interoperability, in addition, trade assoeiations on the legal liability provisions also relatively simple, which can＇t play the role of law. To our country, we should apply rule of perse and rule of reason flexibly according to the need of practice to regulate the trade associations＇ behaviors restricting competition with reference to the legislative and practical experience of the United States and other countries. Besides, the regulatory bodies should establish prevention and post-treatment system to better regulate trade associations＇ behaviors restricting competition.
