| 摘 要： | 广义刑事政策视角下的法治原则是刑事政策原则体系中最根本的原则,它是贯穿于刑事政策活动始终,在整个反犯罪斗争体系中组织和发挥作用方式的基本准则。刑事政策的法治原则是指在制定与实施犯罪防止对策时必须受到法律体系支配和约束。刑事政策的法治原则包括宪法至上原则、法律面前人人平等原则、刑事法律原则和社会主义法制的基本要求。
