| 摘 要： | 土地承包经营权流转是在家庭联产承包责任制基础上对农村土地产权制度的深化改革.一方面通过对土地承包经营权的法律界定,进一步完善土地承包经营权权能,真正落实农民对土地财产的权利;另一方面,通过土地经营权集中,进一步推进农业规模经营,加快由传统农业向现代农业转变的进程.土地承包经营权流转体现了社会化大生产的基本要求和发展趋势,符合现代市场经济的基本原则.土地承包经营权流转不涉及改变土地集体所有性质的问题.
