| 摘 要： | 刑法学界关于“不能为身份犯的直接正犯者能否为间接正犯”的问题争论不休，其中有肯定说、否定说和折中说之分野。深入分析各种学说的见解，考察问接正犯的构成要件应当从整体出发，将身份者和构成要件身份区别对待，那么，肯定无身份者也能为身份犯的间接正犯也就是顺理成章的结论。

| Abstract: | Controversy over whether someone who can＇t be immediate-principal offender can be indirect guilt or not exists in the academic circle of criminal law. There are three isms： the Affirmation, the Negation and the Neutralism. In this paper, the opinion of every ism is analyzed in-depth. And the possibility that someone who has no connatural status and legal status can commit standard status crime is proven in the analysis of the special property of the indirect guilt. |
