| 摘 要： | 宪政以保障和实现人权为出发点和归宿。受二元户籍制度、不平等就业制度以及二元社会保障制度的影响，农村流动人口在劳动就业、同工同酬、社会保障及其子女受教育等方面的人权保障缺失。为此，应树立利益共生体的公共服务理念，深化居民户籍制度改革，创新农村流动人口权益保障制度，构建梯度累进的公共服务获得机制，以充分保障农村流动人口的人权。

| Abstract: | Constitutionalism focus on restrictions on the human right. However, affected by dualistic household registration system, unfair employment system and dualistic social security system, the rural migrants suffered great in employment, payment and social security and so on. To solve those problems, the author suggested： to form the concept of public service of interest co-existence, to strengthen the household registration system reformation, to innovate the right guarantee system of rural migrants, to build a progressive gradient mechanism of public service getting. |
