| 摘 要： | 目前,海峡两岸金融监管机构合作进入了实质阶段,但是海峡两岸的金融法律制度仍未与之相配套,其中金融监管体制的差异成为了海峡两岸金融监管合作的最主要法律壁垒。海峡两岸金融监管机构应借鉴欧盟金融服务法推行相互承认原则的成功经验,确定海峡两岸金融监管合作的原则,进而整合海峡两岸金融法律制度,以消除金融监管合作中的法律壁垒。

| Abstract: | Currently, the cross-strait financial supervision institutions entered a substantive stage, but the financial and legal institutions are not matched by the cross-strait, with which differences between the financial regulatory systems have become the most main legal barriers about the cross-strait financial supervision and cooperation. The cross-strait need to learn the principle of mutual recognition from European Union, establish the principles of the system in building cross-strait financial supervision and cooperation in order to clarify the specific system of financial supervision cooperation and eliminate the legal barriers in financial supervision cooperation. |
