预售商品房转让的若干问题

摘    要:
商品房预售在我国商品房买卖中占据重要地位,而我国相关的法律规定尚不完善,对此学界存在较大分歧。本文首先从预售商品房转让的概念、客体、法律属性、要件等方面做了解析,对其存在的合理性作了分析,并对现状存在的问题提出立法建议,使预购方对转让的期房引起足够重视,以维护预购方的合法权益。

Abstract:
Commercial houses for selling holds a very important status in our countries' commercial houses' business.While the correlative laws of our county are not complete,great bifurcation on this point exists on the study field.This article firstly makes brief analysis on the attornment of commercial houses for selling from the aspects of concepts,objects,legal attribute,and important document,etc,analyzing its existential rationality.And it puts forward legislative suggestions on the existential issues of the status quo,which makes the purchasers in advance arise sufficient recognition on the houses expected,to maintain the legitimate rights and interests of the purchasers in advance.
