法治视野下市民社会的回应与建构

市民社会是法治良性运行的社会基础,市民社会对法治具有孕育法律信仰、确保权利实现、确立理性规则等功能。由于市场经济尚不完善、社会结构不平衡、社会组织不独立、传统礼俗排斥理性社会关系等原因,导致我国市民社会发育还不成熟,为此要完善社会主义市场经济体制、统筹城乡协调发展、扩大中间阶层比重、推动文化世俗化、强化民间社会组织。

Civil Society is the social basis of well - running law,to law, civil society have the functions such as law beliefs occurrence, assurance of rights realization, establishing rational rules. Because our market economy is not yet perfect, our social construction is not balanced, our social institutions are not independent, and our traditional manners and culture excludes rational society etc, our civil society is not perfect yet, so we have to perfect our social market economy system, overall plan development between cities and villages, widen the proportion of the mid - class people, drive the cultural common customs forward, and strengthen local social institutions.
