| 摘 要： | 土地使用权与地上建筑物所有权是房地产法学的热点问题之一。随着中国房地产市场的发展成熟 ,中国现有房地产司法体例与市场现状的冲突逐渐突出。作者结合自己在法律实务中的体会 ,从分析土地与地上建筑物的法律关系出发 ,就改进中国当前房地产司法体例提出几点建议

| Abstract: | The usufruct of land and buildings' ownership is one of hot topics in law science of real estate.The conflict between justice system and real estate surroundings is extruded with the booming of real estate. So ,the writer gives some advises to mend the real estate system of China,according to the experience from attorney and the analysis of legal relationship. |
