| 摘 要： | 市民社会是与政治国家相对应的社会生活领域。独立的市民社会是法治形成的必要社会条件。西方中世纪后期市民社会运动为近代法治确立奠定了基础。市场经济作为市民社会的经济形式促进法律的形式合理性发展,并孕育社会普遍的法治理念。市民社会权利以各种形式制约国家权力。

| Abstract: | Civil society is the field of societal life, as opposed to the political state. Independent civil society is the indispensable condition for the formation of the rule of law. The movements of civil society in late Middle Ages laid the foundation for the formation of the rule of law. Market economy enhanced reasonable developments in the formality of legal system and also the spirit of the rule of law. The rights of civil society restrict the power of the state. |
