| 摘 要： | 我国大陆与台湾地区未成年人犯罪中“未成年人”的界定相同，未成年人犯罪刑罚适用种类也大多相同。我国大陆与台湾地区未成年人犯罪刑罚适用之差异表现为：未成年犯罪人的刑事责任范围不同，未成年人犯罪刑罚适用种类有一些不同；未成年人犯罪的具体量刑制度不同；在个别犯罪上对未成年人设置的刑罚不同等。通过比较得出对完善我国大陆未成年人犯罪刑罚适用的启示是：调整相对刑事责任年龄阶段人的刑事责任范围，在刑法中明确规定未成年人犯罪不适用无期徒刑和剥夺政治权利，增设针对未成年人犯罪的特别量刑制度等。
