浅析《劳动合同法》第二十二条

摘    要:2008年1月1日施行的《劳动合同法》将劳动合同中违约金的适用范围限制在服务期与竞业禁止两方面,从而在弱劳力强资本的客观情况下,有利于保护劳动者的合法权益。但在实践中,关于职业培训的违约金条款,显现出不可操作性和抽象性等问题。在劳动争议大量增多的趋势下,有必要对该违约金条款进行理论探讨,以期加强劳动合同法的实用性,更好地保障劳动者的合法权益。

Abstract:The application scope of compensation for break of contract was restricted in two aspects,namely service period and prohibition of business strife since the Labor contract Law was implemented in January 1st,2008,thus it is beneficial to the protection of labor's legal rights and interests under the objective circumstances of weak labor and strong capital.However,in practice,the items of compensation for breach of contract on vocational training show operational and Abstract problems etc.Therefore,under the tendency of extensive increase in labor dispute,it is of great necessity to give a further theoretical study on the items of compensation for breach of contract in order to strengthen the practicality of the labor contract law and better protect the labor's legal rights and interests.
