| 摘 要： | 大陆法系意思表示错误的传统内在态样结构将表示错误与动机错误作严格区分,是一种表示错误——动机错误的二元化错误结构。然则,将动机错误人为纳入其中并与表示错误作严格区分,不利于实践中意思表示错误问题的解决,纯粹动机错误与适格的意思表示、非常态的动机错误与表示错误(特别是内容错误)存在着现实运用中的混淆与复杂化。对意思表示错误的内在态样结构重新定位,将意思表示错误的二元内在结构回归至意思表示错误的一元内在结构或许具有更积极的现实意义。

| Abstract: | Civil law countries make a strict distinction between mistake in expression and that of will in the inherent structural form involving mistake of express of will. However, the distinction is useless for solving problems in practice and it will confuse the utilities in reality. We think that reconstructing the structural form of mistake in expression of will is significant and useful in realities. |
