| 摘 要： | 我国合同法将附随义务成文化后,附随义务被大量引入司法实践。但因附随义务的不确定性和附随性特点,给它的适用带来了诸多不确定的因素。本文拟用体系化的思考方法,分析附随义务产生的理论基础及立法本意,从而对附随义务的界定和适用提出几点自己的看法。 |

| Abstract: | After the formation of collateral obligation with the contract in our country, it is now widely used in practice. However, because of the characters of the contract such as uncertainties and collateralities, it brings uncertainties to the practice of collateral obligation. This paper discusses systematic thoughts and analyses the theory foundation and its purpose of legislation in collateral obligation, so that the writer of this paper is able to propose some ideas in collateral obligation about its definition and practice. |
