高校学生处分救济方式存在的问题分析

目前,因处分不当引起高校与学生之间的纠纷时有发生,根据新的《普通高等学校学生管理规定》,高校学生如对处分不服可以通过申诉或诉讼两种方式获得处分后的救济。但在救济方式的选择与操作中还存在许多问题,根据高校的管理特点以及处分的种类,为了更好的维护学生的合法权益,应进一步完善学生申诉体制,明确救济方式的选择,加强申诉与诉讼之间的衔接。

Analysis of the Existing Problems for the University Students' Punishments and Relief

At present,some conflict appears as a result of the inappropriate ways of punishment.University students can obtain relevant support through two different ways such as appealing and accusation,according to the regulation of the management for students in general university if they do not accept the punishment.But some problems still exist in the ways of supporting and in the procedure of operating.To maintain the students' legal rights based on the management features and the varieties of punishment,the students' appealing system should be made perfect,the choice of the ways of relief should made further clear,and the connection between appealing and accusation should be strengthened.
